1. The agreement
These Terms of Service (the “Terms”) are a contract between you and Range Lab LLC(“Range Lab”, “we”, “us”) governing your use of Fancyphonebook and the fancyphonebook.com website (together, the “Service”). By creating an account or using the Service you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you have authority to bind it.
Our Privacy Policy is part of these Terms.
2. The service
Fancyphonebook is a contact and relationship manager: it stores contacts and organizations, tracks leads and follow-ups, keeps notes and files, schedules meetings, and sends email on your behalf. We may add, change, or remove features over time. If we discontinue a feature you depend on, we will give reasonable notice where we can.
3. Accounts
- You must be at least 16 years old to use the Service.
- You are responsible for your account credentials and for everything that happens under your account. Tell us promptly at privacy@fancyphonebook.com if you suspect unauthorized access.
- Provide accurate registration information and keep it current.
- A workspace owner controls who may join their workspace and what members can see. Members should understand that workspace content is visible to other members according to those settings.
4. Your content
Everything you put into Fancyphonebook — contact records, notes, files, templates — remains yours. You grant Range Lab a limited licence to host, store, transmit, and display that content solely to operate the Service for you.
You are responsible for the content you upload. In particular:
- You must have a lawful basis to store and process information about the people in your workspace, and you must honour their privacy rights.
- You must not upload content that infringes someone else's rights or that is unlawful.
- You must not upload sensitive categories of data — health records, government identifiers, payment card numbers, or similar — unless you have confirmed with us in writing that the Service is suitable for it.
You can export your workspace at any time, and you can delete your content at any time.
5. Acceptable use
You agree not to:
- Break the law, or help anyone else do so, using the Service.
- Probe, scan, or test the vulnerability of the Service, or breach its security or authentication measures, without our written permission.
- Access another customer's workspace or data, or attempt to.
- Reverse engineer the Service, or resell or sublicense it, except as permitted by law.
- Place an unreasonable load on our infrastructure, including automated scraping or bulk requests outside documented interfaces.
- Upload malware or other harmful code.
6. Sending email
When you send email through Fancyphonebook, you are the sender. You are responsible for complying with anti-spam law, including CAN-SPAM in the United States, CASL in Canada, and the GDPR and ePrivacy rules in Europe.
- Send only to recipients who have a genuine relationship with you or who have consented to hear from you.
- Do not send to purchased, rented, scraped, or otherwise harvested lists.
- Do not remove, obscure, or defeat the unsubscribe mechanism we include in outbound mail.
- Honour unsubscribe requests. We maintain a suppression list per workspace and will not deliver to addresses on it.
Workspaces sending from our shared domain are subject to a daily recipient cap. We may throttle, suspend, or terminate sending privileges if your activity generates excessive bounces or spam complaints, or threatens the deliverability of the platform for other customers.
7. Plans and billing
Some features are offered on paid plans. Fees, billing intervals, and any usage limits are those shown at the time you subscribe. Unless stated otherwise:
- Subscriptions renew automatically until you cancel.
- Fees are charged in advance and are non-refundable except where required by law.
- You may cancel at any time; your plan continues until the end of the current billing period.
- We may change pricing with at least 30 days' notice before it affects your next renewal.
- Fees are exclusive of taxes, which we will add where required.
Payments are processed by Stripe. If a payment fails, we may suspend access to paid features until it is resolved.
8. Early access and beta features
We may label some features as beta, preview, or early access. Those features are provided for evaluation, may change or disappear, and are excluded from any service commitments. Use them with that in mind.
9. Intellectual property
The Service, including its software, design, and trademarks, belongs to Range Lab and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer ownership of anything.
If you send us feedback or suggestions, we may use them without obligation to you.
10. Third-party services
Fancyphonebook can connect to services we do not control, such as Google Calendar. Your use of those services is governed by their own terms, and we are not responsible for them. If a third-party service changes or becomes unavailable, the corresponding Fancyphonebook feature may stop working.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if your use puts the Service or other customers at risk, or if we are required to by law. Where circumstances allow, we will give notice and an opportunity to fix the problem first.
After termination you have 30 days to export your data, after which we may delete it as described in the Privacy Policy.
12. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Range Lab disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your requirements.
You are responsible for maintaining your own backups of data that matters to you.
13. Limitation of liability
To the fullest extent permitted by law, Range Lab will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to the Service.
Our total liability for all claims relating to the Service in any twelve-month period is limited to the greater of the amounts you paid us for the Service during that period, or one hundred US dollars.
Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.
14. Indemnification
You agree to indemnify and hold Range Lab harmless from claims, damages, and reasonable legal costs arising from your content, your use of the Service, or your breach of these Terms — including claims brought by people whose personal information you stored or emailed through Fancyphonebook.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in California have exclusive jurisdiction over any dispute arising from these Terms or the Service, and both parties consent to venue there.
Before filing a claim, please contact us — most disputes can be resolved informally, and we will try in good faith to do so.
16. Changes to these Terms
We may update these Terms as the Service evolves. When we make a material change we will update the effective date above and notify account holders by email or in-product notice before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
